OVERVIEW

This website is operated by BestBongz.ca (referred to in these Terms as “BestBongz,” “we,” “us” or “our”). BestBongz offers this website, including its information, features, products and services, to you subject to these Terms of Service and the policies referenced below.

By visiting the website, creating an account, placing an order or otherwise using our services, you agree to these Terms. If you do not agree, do not use the website or place an order.

These Terms apply together with our Privacy Policy, Shipping Policy and Return Policy. Nothing in these Terms limits a right or remedy that cannot legally be excluded under applicable Canadian federal or provincial consumer-protection law.

1. ELIGIBILITY AND LEGAL AGE

This website and its products are intended only for adults.

You must be at least 18 years old and must also meet the higher minimum legal age, if any, that applies in the province or territory where you reside and where the order will be delivered.

By using the website or placing an order, you represent that:

- You meet the applicable legal-age requirement.
- You are legally capable of entering into a binding agreement.
- You are purchasing for yourself or another person who meets the applicable legal-age requirement.
- The purchase, possession and intended use of the products are lawful where you reside and where the products will be delivered.

We may request valid government-issued identification or use an age-verification service. We may refuse or cancel an order when age cannot be verified. The person accepting delivery may also be required to provide proof of age where required by law or the carrier.

2. CANADIAN SALES ONLY

BestBongz.ca currently sells and ships exclusively within Canada.

We do not currently accept orders for delivery to the United States or other international destinations. You are responsible for complying with all federal, provincial, territorial and local laws that apply to your purchase, possession and use of a product.

3. LAWFUL AND RESPONSIBLE USE

Products sold through BestBongz.ca are intended only for lawful adult use. We do not encourage, authorize or condone the use of any product with an illegal substance or in a manner that violates applicable law.

You are responsible for determining whether a product is lawful and appropriate for your intended use. BestBongz is not responsible for unlawful use, misuse, modification, unsafe handling or use contrary to the manufacturer’s instructions.

Smoking and vaping can expose users and bystanders to harmful substances. Nicotine is addictive. Products sold through this website are not medical devices and are not intended to diagnose, treat, cure or prevent any disease or to serve as approved smoking-cessation products unless expressly authorized and labelled for that purpose by the appropriate Canadian regulator.

Keep all products, batteries, components and packaging away from children and pets. Do not use damaged glass, batteries, chargers, vaporizers or other components. Follow all manufacturer safety, charging, cleaning and compatibility instructions.

4. PRODUCT INFORMATION

We make reasonable efforts to display product descriptions, specifications, photographs, colours, dimensions, compatibility information, availability and prices accurately.

However:

- Colours and appearance may vary depending on the screen, lighting and manufacturing batch.
- Handmade glass may contain minor variations in shape, colour, dimensions or decorative details.
- Measurements are approximate unless expressly stated otherwise.
- Product packaging and manufacturer specifications may change without notice.
- Lifestyle images may show accessories or props that are not included with the product.

Please review product details carefully before ordering. For replacement parts and accessories, you are responsible for confirming measurements, joint size, joint gender and compatibility. Contact us before ordering if you require assistance.

5. PRODUCTS AND AVAILABILITY

Products and services may be available exclusively online and may be offered in limited quantities.

We may change or discontinue a product, limit quantities, restrict sales to particular persons or regions, or correct product information at any time, subject to applicable law. Displaying a product on the website does not guarantee availability or constitute acceptance of an order.

We reserve the right to refuse service or limit an order when reasonably necessary, including for suspected fraud, resale activity, age-verification failure, abusive conduct, pricing errors, inventory errors, payment problems, legal restrictions or delivery limitations.

We will not refuse service on a basis prohibited by applicable human-rights law.

6. ACCOUNTS AND CUSTOMER INFORMATION

You agree to provide current, complete and accurate information when creating an account or placing an order. You are responsible for maintaining the confidentiality of your login credentials and for activity conducted through your account.

Notify us promptly if you believe your account or payment information has been used without authorization. We may suspend or terminate an account to protect you, BestBongz or other customers from suspected fraud, misuse or security threats.

7. ORDERS AND CONTRACT FORMATION

Submitting an order is an offer to purchase the products in your cart. An automated order confirmation acknowledges that we received the order but does not necessarily mean that the order has been accepted or shipped.

An order is accepted when we confirm shipment or otherwise expressly confirm acceptance. Before acceptance, we may verify payment, inventory, age, address, product restrictions and other order information.

We may refuse or cancel an order before shipment for a legitimate reason, including:

- An item is unavailable.
- Product or pricing information contains a material error.
- Payment cannot be authorized or is reversed.
- We cannot verify age, identity or delivery information.
- The order appears fraudulent, abusive or intended for unlawful resale.
- We cannot lawfully or reasonably deliver the order.

If we cancel an order after payment has been collected, we will issue an appropriate refund to the original payment method, subject to payment-provider processing times.

8. PRICES, TAXES AND PAYMENT

Unless stated otherwise, prices are displayed in Canadian dollars and exclude applicable taxes and shipping charges.

Applicable GST, HST, PST, QST or other taxes will be calculated based on the order and delivery information available at checkout.

You agree to pay all charges shown before submitting the order. By providing payment information, you represent that you are authorized to use the selected payment method and authorize us and our payment providers to process the transaction.

Payment services may be provided by third parties and may be subject to their own terms. Approved refunds are processed through the original payment method whenever possible. Orders paid through Sezzle will be refunded through Sezzle’s system. Approved direct-deposit refunds will be arranged with the verified purchaser.

The payment method used does not eliminate any refund, cancellation or consumer-protection right that applies by law.

9. PRICING AND TYPOGRAPHICAL ERRORS

We may correct typographical errors, inaccurate descriptions, incorrect prices, promotions, shipping charges, availability information or other errors.

If an obvious pricing or product-information error is discovered before an order is accepted, we may cancel the affected order and notify you. If payment has already been collected, we will refund the cancelled amount.

We will not retroactively change the agreed price of an accepted order except where permitted by law or with your express agreement.

10. SHIPPING AND DELIVERY

Shipping destinations, processing times, delivery estimates, free-shipping eligibility, remote-area surcharges, address requirements, tracking information and discreet-packaging practices are described in our Shipping Policy:

Delivery dates are estimates unless expressly guaranteed. Carrier delays, weather, labour disruptions, remote-area access, holidays and other circumstances outside our reasonable control may affect delivery.

You are responsible for providing a complete and accurate delivery address. Additional costs resulting from an incorrect address, refusal of delivery or failure to collect a package may be charged as described in our Shipping Policy.

11. RETURNS, DAMAGES AND REFUNDS

Our rules for damaged, defective, incorrect, missing, lost or stolen orders and approved returns are described in our Return Policy:

Used personal-use products cannot be returned except where required by applicable law. Do not use, wash, fill, repair, modify or discard a product that arrived damaged, defective or incorrect before contacting us.

Customers must inspect orders promptly and report damaged, defective, incorrect or missing items within the reporting period stated in the Return Policy. This reporting requirement does not eliminate a legal right that cannot be waived under applicable law.

Optional Route Package Protection is governed by Route’s current terms, eligibility requirements, exclusions and filing deadlines. Route coverage does not replace BestBongz’s responsibility for confirmed fulfillment errors such as sending the wrong product.

12. FRAUDULENT OR UNAUTHORIZED TRANSACTIONS

If you believe an unauthorized transaction involving BestBongz has appeared on your payment account, contact your financial institution and email us promptly at bestbongztoronto@gmail.com.

If you receive an unexpected BestBongz package, do not use its contents. Contact us for instructions. Do not mail a package back without authorization, because an untracked or incorrectly addressed return may be lost.

We may request information reasonably necessary to investigate an unauthorized transaction. Nothing in this section limits chargeback or consumer rights available through your financial institution or applicable law.

13. PROHIBITED USES

You may not use the website or its content:

- For an unlawful, fraudulent or deceptive purpose.
- To purchase or obtain regulated products for a minor or other ineligible person.
- To violate intellectual-property, privacy, publicity or other legal rights.
- To harass, threaten, defame, impersonate or discriminate against another person.
- To submit false order, identity, age, payment or delivery information.
- To transmit malware, malicious code or harmful automated requests.
- To scrape, crawl, copy or commercially exploit the website without written authorization.
- To interfere with the website’s security, operation or other customers’ use.
- To send spam or collect personal information about others without authorization.
- To resell products unlawfully or evade product, quantity or regional restrictions.

We may suspend access, cancel an order or terminate an account for a material violation of these Terms, subject to applicable law.

14. INTELLECTUAL PROPERTY

Unless otherwise indicated, the website and its original content—including text, graphics, logos, photographs, videos, page designs, software and compilations—are owned by or licensed to BestBongz and are protected by applicable intellectual-property laws.

You may view and print reasonable portions of the website for personal, non-commercial shopping and record-keeping purposes. You may not reproduce, distribute, modify, publish, sell, license, create derivative works from or commercially exploit website content without prior written permission from the applicable rights holder.

Third-party product names, trademarks, photographs and content remain the property of their respective owners.

15. REVIEWS, FEEDBACK AND USER CONTENT

If you submit a review, photograph, comment, suggestion or other content, you represent that:

- You own the content or have permission to submit it.
- The content is truthful and based on your genuine experience where presented as a review.
- The content does not violate law or another person’s rights.
- The content does not contain malicious code, confidential information, harassment, threats or unlawful material.

You grant BestBongz a non-exclusive, worldwide, royalty-free licence to host, reproduce, format and display the submitted content for operating and promoting the website and business, subject to our Privacy Policy and applicable law.

We may moderate or remove content that violates these Terms, is fraudulent or is unrelated to the product or service being reviewed. We are not required to publish every submission.

16. THIRD-PARTY SERVICES, TOOLS AND LINKS

The website may use or link to services operated by third parties, including Shopify, payment providers, financing providers, shipping carriers, Route, analytics providers, advertising services and social-media platforms.

Third-party services may have separate terms and privacy practices. We do not control third-party websites and are not responsible for their independent content, availability or conduct. A link does not necessarily mean that BestBongz endorses the third party.

Your use of a third-party service is subject to the terms that apply between you and that provider. This section does not exclude responsibility that applicable law assigns to BestBongz.

18. WEBSITE AVAILABILITY AND SECURITY

We aim to keep the website accurate, secure and available, but we cannot promise uninterrupted or error-free operation. Maintenance, updates, service-provider failures, cyber incidents or circumstances outside our control may temporarily affect access.

You are responsible for using reasonable security precautions, including maintaining current device software and protecting your account credentials.

19. WARRANTIES AND CONSUMER RIGHTS

To the extent permitted by law, the website and its general informational content are provided on an “as available” basis without a guarantee that access will always be uninterrupted, secure or error-free.

Product warranties, if any, are limited to those expressly provided by BestBongz or the manufacturer. Some products may also carry statutory warranties or conditions that cannot legally be excluded.

Nothing in these Terms excludes, restricts or modifies a warranty, condition, representation, right or remedy that cannot lawfully be excluded or limited under applicable consumer-protection law.

20. LIMITATION OF LIABILITY

To the maximum extent permitted by applicable law, BestBongz will not be liable for indirect, incidental, special or consequential losses arising from use of the website or products when such losses were not reasonably foreseeable.

This limitation does not apply to liability that cannot legally be excluded or limited, including liability arising from fraud, wilful misconduct, gross negligence, or death or personal injury caused by negligence where applicable law prohibits such a limitation.

You are responsible for using products lawfully, safely, for their intended purpose and in accordance with instructions and warnings. BestBongz is not responsible for damage caused by misuse, unauthorized modification, incompatible components, unsafe charging, accidental breakage after delivery or use contrary to instructions.

21. INDEMNIFICATION

To the extent permitted by law, you agree to indemnify BestBongz and its officers, employees and service providers against third-party claims, damages and reasonable costs directly resulting from your unlawful use of the website, your material breach of these Terms, or your infringement of another person’s rights.

This section does not require you to indemnify BestBongz for its own negligence, unlawful conduct or breach of these Terms.

22. EVENTS OUTSIDE REASONABLE CONTROL

BestBongz is not responsible for a delay or failure caused by an event outside its reasonable control, including severe weather, natural disaster, fire, epidemic, labour disruption, carrier interruption, government action, network outage or supply-chain disruption.

This section does not remove any cancellation, refund or delivery right that applies under consumer-protection law.

23. TERMINATION

You may stop using the website at any time.

We may suspend or terminate access when reasonably necessary because of fraud, security risk, unlawful conduct or a material breach of these Terms. Rights and obligations that by their nature should survive termination—including payment obligations, intellectual-property rights, disclaimers and limitations permitted by law—will continue to apply.

24. CHANGES TO THESE TERMS

We may update these Terms to reflect changes in law, technology, business operations, products or services. The revised version will be posted on this page with a new “Last updated” date.

Changes apply prospectively from the date they are posted unless applicable law permits or requires otherwise. The Terms in effect when an order is accepted will generally govern that order.

25. GOVERNING LAW

These Terms and your use of the website are governed by the laws of Ontario and the applicable federal laws of Canada, without regard to conflict-of-law principles.

The courts located in Ontario will have jurisdiction over disputes, except where applicable consumer law gives you the right to bring a proceeding in another jurisdiction or prohibits this choice of forum.

The United Nations Convention on Contracts for the International Sale of Goods does not apply.

26. SEVERABILITY

If a provision of these Terms is found to be invalid or unenforceable, it will be limited or removed only to the extent necessary. The remaining provisions will continue in effect.

27. NO WAIVER

If BestBongz does not immediately enforce a provision of these Terms, that does not waive the provision or the right to enforce it later.

28. ASSIGNMENT

You may not transfer your rights or obligations under these Terms without our written consent.

BestBongz may transfer its rights and obligations as part of a merger, reorganization, financing, sale of business or transfer of the website, provided that the transfer does not reduce rights that cannot legally be reduced.

29. ENTIRE AGREEMENT

These Terms, together with the policies and order information referenced in them, form the agreement between you and BestBongz concerning use of the website and purchases made through it.

If these Terms conflict with a specific product warranty, promotion or written agreement, the more specific terms will apply to that subject, provided they comply with applicable law.
